  1. DOANH NGHIỆP CHẾ XUẤT LÀ GÌ?

Doanh nghiệp chế xuất (DNCX) hay còn gọi là doanh nghiệp EPE, là doanh nghiệp được thành lập và hoạt động trong khu chế xuất hoặc doanh nghiệp chuyên tập trung sản xuất hàng hóa xuất khẩu.

  1. KHU CHẾ XUẤT LÀ GÌ? PHÂN BIỆT KHU CHẾ XUẤT VÀ KHU PHI THUẾ QUAN

2.1. Khu chế xuất là gì?
Khu chế xuất là đặc khu công nghiệp chuyên tập trung sản xuất hàng hóa để xuất khẩu, cung cấp các dịch vụ cho sản xuất hàng hóa để xuất khẩu và hoạt động để xuất khẩu hàng hóa, có đầy đủ địa giới xác định, do Cơ quan nhà nước thành lập hoặc cho phép thành lập.

2.2. Phân biệt khu chế xuất và khu phi thuế quan
Khu phi thuế quan là đặc khu kinh tế thuộc quốc gia Việt Nam, được lập ra theo quy định của pháp luật, có địa giới xác định, ngăn cách với khu vực bên ngoài bằng hàng rào, đảm bảo điều kiện cho hoạt động kiểm tra, giám và kiểm soát hải quan của cơ quan hải quan và các cơ quan khác có liên quan đối với hàng hóa xuất nhập khẩu và phương tiện, hành khách xuất và nhập cảnh; quan hệ mua bán và trao đổi hàng hóa giữa khu phi thuế quan với bên ngoài là quan hệ xuất khẩu, nhập khẩu.

Theo văn bản số 16/VBHN-BTC và quyết định số 100/2009/QĐ-TTg của Thủ tướng Chính phủ về khu phi thuế quan bao gồm:

  • Khu chế xuất;
  • Doanh nghiệp chế xuất;
  • Kho bảo thuế;
  • Khu bảo thuế;
  • Kho ngoại quan;
  • Đặc khu kinh tế thương mại đặc biệt;
  • Đặc khu thương mại – công nghiệp;
  • Các khu vực kinh tế khác được lập ra và được hưởng ưu đãi về thuế suất giống như khu phi thuế quan theo quyết định của Thủ tướng Chính phủ.

➥ Như vậy khu chế xuất chỉ là khu vực chuyên sản xuất hàng hóa và cung cấp dịch vụ để xuất khẩu còn khu phi thuế quan là khu vực kinh tế được thành lập bao gồm nhiều khu vực kinh tế khác có các chức năng khác nhau và bao gồm khu chế xuất.

III. THỦ TỤC BÁN HÀNG, CUNG CẤP DỊCH VỤ CHO DOANH NGHIỆP CHẾ SUẤT

  1. Thủ tục hải quan bán hàng vào khu chế xuất, doanh nghiệp chế xuất
    Doanh nghiệp muốn bán hàng vào khu chế xuất thì sẽ phải làm thủ tục mở tờ khai hải quan.

Để mở tờ khai doanh nghiệp cần chuẩn bị hồ sơ như sau:

  • Hợp đồng mua bán;
  • Hóa đơn giá trị gia tăng;
  • Packing list;
  • Các chứng từ khác nếu hàng hóa sản xuất thuộc đối tượng phải kiểm tra chuyên ngành hay kiểm tra chất lượng.

Lưu ý:
Một số trường hợp đặc biệt khi doanh nghiệp bán hàng cho DNCX nhưng không phải thực hiện làm thủ tục hải quan, cụ thể:

– Bán các sản phẩm phần mềm;
– Hàng hóa là vật liệu xây dựng để xây dựng công trình trong khu chế xuất;
– Lương thực, thực phẩm, văn phòng phẩm, hàng tiêu dùng (bao gồm vật bảo hộ lao động là: quần, áo, mũ, giầy, ủng và găng tay) phục vụ hoạt động văn phòng, sinh hoạt của cán bộ làm việc trong các doanh nghiệp chế xuất.
2. Thủ tục cung cấp dịch vụ cho khu chế xuất, doanh nghiệp chế xuất
Khi doanh nghiệp cung cấp dịch vụ cho doanh nghiệp chế xuất thì không cần làm thủ tục mở tờ khai hải quan. Doanh nghiệp chỉ cần ký hợp đồng cung cấp dịch vụ với DNCX.

III. THUẾ SUẤT THUẾ GTGT KHI BÁN HÀNG, CUNG CẤP DỊCH VỤ CHO DNCX

Theo quy định tại Khoản 1 Điều 9, Thông tư 219/2013/TT-BTC ngày 31/12/2013 của Bộ Tài chính thì thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44} áp dụng đối với các loại hàng hóa, loại hình dịch vụ xuất khẩu; xây dựng, lắp đặt công trình ở nước ngoài và ở trong khu phi thuế quan; vận chuyển xuyên quốc gia; bán hàng hóa, cung cấp dịch vụ thuộc diện không chịu thuế GTGT khi xuất khẩu. Hàng hóa, dịch vụ để xuất khẩu là hàng hóa, dịch vụ được bán, cung cấp cho tổ chức hoặc cá nhân ở nước ngoài và tiêu dùng ở ngoài Việt Nam; bán, cung cấp cho tổ chức hoặc cá nhân trong khu phi thuế quan; bán hàng hóa, dịch vụ được cung cấp cho khách hàng nước ngoài theo quy định của pháp luật.
➥ Như vậy bán hàng hóa và cung cấp dịch vụ vào khu chế xuất là hoạt động xuất khẩu sẽ chịu thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44}.

Tuy nhiên để được hưởng thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44}, cũng sẽ phải đi kèm một số điều kiện như sau:
➤ Điều kiện hưởng thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44} khi bán hàng hóa khu chế xuất

  • Có hợp đồng mua bán;
  • Có chứng từ thu tiền bán hàng qua ngân hàng;
  • Có bộ tờ khai hải quan (trừ các trường hợp bán hàng cho doanh nghiệp chế xuất không phải mở tờ khai Anpha đã nêu ở trên).

Khi đó:

– Nếu doanh nghiệp bán hàng hóa vào trong khu chế xuất thiếu tờ khai hải quan thì hàng hóa bán cho doanh nghiệp chế xuất sẽ không được hưởng thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44} mà sẽ phải tính theo mức thuế suất hiện hành của hàng hóa đó như bán hàng cho các doanh nghiệp nội địa;
– Nếu doanh nghiệp không có các chứng từ thanh toán qua các ngân hàng nhưng vẫn có tờ khai hải quan thì doanh nghiệp bán hàng vào khu chế xuất được xuất hóa đơn với thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44} nhưng thuế GTGT đầu vào không được khấu trừ.

Lưu ý:
Một số mặt hàng khi bán hàng cho doanh nghiệp chế xuất không được tính là hoạt động xuất khẩu, nên không được áp dụng thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44} mà áp dụng như đối với bán hàng cho doanh nghiệp nội địa đó là xe ô tô, và xăng dầu cho xe ô tô của DNCX.
➤ Điều kiện hưởng thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44} khi cung cấp dịch vụ vào khu chế xuất

  • Có hợp đồng cung cấp dịch vụ;
  • Có chứng từ thu tiền qua ngân hàng;
  • Có giấy phép đầu tư (photo) để chứng minh đối tác của doanh nghiệp là DNCX.

Doanh nghiệp có đủ các hồ sơ nên trên thì sẽ được áp dụng thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44}. Tuy nhiên trừ một số dịch vụ đặc biệt sẽ không được áp dụng thuế suất 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44}. Bao gồm:

  • Dịch vụ vận chuyển người lao động;
  • Dịch vụ ăn uống (trừ cung cấp suất ăn công nghiệp, dịch vụ ăn uống ở trong khu chế xuất);
  • Dịch vụ cho thuê nhà để ở hoặc kinh doanh, hội trường lớn, văn phòng làm việc, khách sạn, kho bãi để hàng.

  1. QUY ĐỊNH VỀ XUẤT HÓA ĐƠN CHO DOANH NGHIỆP CHẾ XUẤT
  2. Doanh nghiệp bán hàng, cung cấp dịch vụ cho khu chế xuất bắt buộc phải xuất hóa đơn
    Tại Khoản 1, Khoản 2 Điều 8 Nghị định số 123, hóa đơn gồm các loại sau:
  • Hóa đơn GTGT dành cho doanh nghiệp khai thuế GTGT theo phương pháp khấu trừ dùng cho hoạt động: Xuất hàng hóa cung cấp dịch vụ vào khu phi thuế quan và các trường hợp được coi như xuất khẩu;
  • Hóa đơn bán hàng dành cho doanh nghiệp khai thuế GTGT theo phương pháp trực tiếp dùng cho các hoạt động: xuất hàng hóa cung cấp dịch vụ vào khu phi thuế quan và các trường hợp được coi như xuất khẩu.

➥ Như vậy, khi bán hàng hóa và cung cấp dịch vụ vào khu chế xuất sẽ phải xuất hóa đơn. Nếu là DN kê khai thuế GTGT theo phương pháp khấu trừ thì sẽ xuất hóa đơn GTGT. Nếu là DN kê khai thuế GTGT theo phương pháp trực tiếp sẽ xuất hóa đơn bán hàng.

  1. Cách viết hóa đơn hàng hóa, dịch vụ vào khu chế xuất
    ➤ Về đơn vị tiền tệ trên hóa đơn:
  • Nếu hai bên thỏa thuận thanh toán bằng VNĐ thì đơn vị tiền tệ ghi trên hóa đơn là số tiền tính theo Việt Nam đồng;
  • Nếu hai bên bán thỏa thuận thanh toán bằng ngoại tệ thì đồng tiền ghi trên hóa đơn là ngoại tệ, nhưng dòng dưới cùng ghi rõ tỷ giá quy đổi để doanh nghiệp làm căn cứ hạch toán (Tỷ giá lấy theo tỷ giá mua của ngân hàng thương mại mà DN dự định thu tiền hàng tại ngày xuất hóa đơn).

➤ Đối với DN sử dụng hóa đơn GTGT thì:

  • Dòng thuế suất thuế GTGT ghi rõ: 0{8ce2139b0b0845f40b75df1fd6b7d4c87ef3ed6cdef6e3584b2dcf2382f05e44};
  • Dòng tiền thuế GTGT ghi rõ: 0.
